The Hotel - part of the STAY hospitality group , operated by companies owned by Marsimos Ltd. (hereinafter: "The Hotel" ) welcomes your choice to browse the website operated at: www.stayhg.com (hereinafter: " the website ").
The Site was established with the aim of providing customers and site visitors with a convenient and secure platform for booking and purchasing accommodation and vacation packages at the hotel (the " Services "). The Site also provides information about the hotel, the accommodation options and other services offered by the hotel. Our privacy policy, published on the Site under the "Privacy Policy" link, regulates the manner in which personal information (as defined in the Privacy Policy) is collected, processed and transferred by us (hereinafter: the " Privacy Policy "). It is clarified that bookings on the Site may be made through a third-party booking platform, Simple Booking , and the information provided as part of the booking process on the aforementioned platform is also subject to the Terms of Use and Privacy Policy of Simple Booking , in addition to our Privacy Policy, to the extent applicable.
Use of the website:
These Terms and Conditions of Use constitute a binding agreement between you, whether individually or through a corporation (" You ") and the Hotel regarding the use of the Services and/or browsing and use of the Site on any computer or other communication device, such as a mobile phone, tablet computers, etc. They also apply to the use of the Site and/or Services , whether via the Internet or via any other network or means of communication, including access to the Site via telephone, application or other means. Read the Terms and Conditions of Use carefully, as browsing the Site and performing actions therein indicate your agreement to the terms contained in these Terms and Conditions of Use (" the Terms "). If you do not agree to all of the provisions of the Terms and Conditions, you may not access or use the Site or the Services.
In the event of a conflict between these Terms and Conditions and any translation into another language, the Hebrew version will prevail in any legal matter or question of interpretation or otherwise.
The Hotel reserves the right to change the terms of the Regulations, from time to time, at its sole discretion and without prior notice. We will notify you of changes to the Regulations by updating the "Last Updated" in the Regulations and you waive any right to receive notice of such changes. Your continued use of the Site or Services after the effective date of the revised Terms will constitute your agreement to the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Site and/or Services .
Purchase and use of the site are intended for persons of legal capacity over the age of 18 only. A minor under the age of 18 may not make a reservation on the site. Booking of accommodation services for minors is permitted only by a parent or legal guardian, who will bear full responsibility for the actions of the minors and for any damage caused by them to the hotel or a third party. The person booking declares that he has the legal authority to make a reservation for all passengers included in the reservation, including minors. Minors under the age of 16 are required to be accompanied by an adult upon arrival in order to gain access to the rooms, hotel and service. Arrival without an adult will be charged according to the cancellation terms of the reservation even if no service was provided due to arrival without an adult. Minors over the age of 16 are required to present a written confirmation of accommodation from a guardian, including the guardian's ID card, as well as an undertaking and authorization to charge a credit card owned by the guardian in the event of damage to the hotel or a third party.

Unless expressly stated otherwise, all copyrights and intellectual property on the Site, including designs, images, databases, software, code, audio, video, text (" the Content ") as well as logos, trademarks, etc. (" the Marks ") are owned solely by the Hotel, or by a third party that has authorized the Hotel or granted the Hotel a license to legally use the Content or Marks, including the Hotel's business partners.
The content and marks are provided " AS IS " for personal use only. Unless otherwise expressly stated, no part of the above may be copied, distributed, publicly displayed, publicly performed, transmitted to the public, modified, processed, created derivative works from, sold or rented, either directly or through or in collaboration with a third party, in any way or means, whether electronic, mechanical, optical, photographic or recording, or in any other way or means, without obtaining prior written consent from the hotel or the other rights holders, as the case may be, and subject to the terms of the consent ( if any).
Provided that you are entitled to browse the website, the hotel grants you a limited license to use it and to download or print a copy of any portion of the content to which proper access has been granted for personal, non-commercial use only.
User statements:
When browsing the site and/or subscribing to the newsletter and/or the hotel /chain's membership club, you undertake and declare as follows:
- (1) browsing the site and using the services are your sole responsibility;
- (2) the details you entered when leaving your details and making a purchase on the site are correct, up-to-date, accurate and complete;
- (3) if necessary, in the event of a change in details, you will update them by contacting the hotel ;
- (4) you have legal capacity and agree to the terms of the regulations;

Prohibited activities on the site and services:
You may not use the Site or the Services except for the purposes for which they are intended . Use of the Site is permitted for private and personal purposes only and may not be used for commercial purposes except those specifically approved by the Hotel in writing. In the event of commercial use of the Site, the Hotel shall be entitled to take legal action against the User.
The hotel may prevent users from making a reservation on the site and/or cancel a user's reservation on the site in the event of inappropriate conduct and/or commercial use of the site and/or unreasonable use of the site and/or services and/or non-compliance with the terms of the regulations and site policies and/or any other reason, in accordance with its sole discretion.
As a user of the website, you agree not to:

- Make any use of the website designs;
- Make unauthorized use of the site, including collecting email addresses, other content, etc. by electronic or other means for the purpose of sending emails by automated means;

- Use information obtained on the Site to harass, abuse or harm another person;
- Use the Site as part of any effort to compete with the Site and/or Services ;
- Retrieve, decode or reverse engineer any part of the Site, a Site feature or Site application;
- Harass, intimidate or threaten any of the employees or agents of the Site and/or the Hotel;
- Delete the copyright or proprietary rights notice from any content or mark;
- Copy or adapt the website code or any part thereof, including but not limited to Flash, PHP, HTML, JavaScript or other code;
- Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material, including spam, that would interfere with the use of the Site;
- Perform an action that will harm or damage the website, at the discretion of the hotel;
- Use the site and/or services in a manner that is inconsistent with the law, regulations and case law.
Any use of the Site and/or Services in violation of the above may result, among other things, in the termination or suspension of your rights to use the Site and/or Services .
Third-party content: The Site may provide links to other sites (hereinafter: " Third Party Sites ") as well as articles, images, text, graphics, photos, designs, music, sound, video, information, applications, software and other content or items belonging to or originating from third party sites (hereinafter: " Third Party Content "). Third party sites and Third Party Content are not investigated, monitored, or reviewed by the Hotel and the Hotel is not responsible for any Third Party Content published through the Site, accessed through the Site, available through the Site or installed therein, including content, opinions, reliability, privacy practices or other policies of or contained on Third Party Sites or Third Party Content. Without derogating from the foregoing, to the extent that reservations are made on the Site through the Simple Booking Platform , use of the said Platform is also subject to the Terms of Use and the Privacy Policy of Simple Booking . Use of a link or permission to use or install any third-party sites or any third-party content does not imply approval or endorsement thereof by us.
The hotel does not take responsibility for any purchases you make from third-party websites or other companies, which will be made and will be valid exclusively between you and the third party. To the extent that a reservation is made through the Simple Booking platform , it is clarified that the platform is provided and operated by a third-party provider, and its use is also subject to its terms and privacy policy, while the reservation and services themselves are provided by the hotel in accordance with the reservation terms, cancellation policy and law.
Website management: We reserve the right to: (1) monitor violations of these Terms of Use; (2) take legal action against anyone who violates the provisions of the law or the provisions of these Terms of Use, at the sole discretion of the Hotel, including, without limitation, reporting the user to law enforcement authorities; (3) refuse, restrict access to, limit availability of, or disable (to the extent technologically possible) any of your contributions to the Site or any part thereof, at the sole discretion of the Hotel and without limitation; and (4) manage the Site in a manner that protects its rights and property and facilitates its proper functioning.
User Content and Copyright Infringement: The Site and/or Services may allow you to add or submit certain content and/or data, such as reviews (hereinafter: " User Content "). The Hotel may collect User Content from other sites.
You are solely responsible for any User Content that you submit and/or upload to the Site and/or the Services. You represent and warrant that the User Content complies with all applicable laws, that you have all the rights necessary to upload or submit the User Content to the Services, and that the User Content does not infringe (or lead to the infringement of) any third party intellectual property right, moral right, right of publicity or right of privacy. We do not undertake to accept, display, review or maintain any User Content. Furthermore, we reserve the right to remove and permanently delete any Content, including User Content, without prior notice, for any reason and at any time. We do not endorse any content, opinion or recommendation expressed in the Content and/or by any User, and we expressly disclaim any liability relating to the Content, including, without limitation, the User Content .
We may choose, in our sole discretion, to monitor User Content to detect inappropriate or illegal behavior, including by automated means; however, the Company is not obligated to monitor User Content or a User’s use of the Services. The Company may do so, and may also remove User Content and/or restrict use of the Services, if in its sole discretion such use or User Content violates any of the User’s obligations under these Terms.
The User Content that you enter, submit, post and/or upload when using the Services and/or the Site is your sole property and all intellectual property rights in your User Content are yours. By entering, submitting, posting or uploading any User Content in connection with the Services and/or the Site, you grant the Company, its successors and assigns a non-exclusive, worldwide, royalty-free, transferable license to use, copy, distribute, transmit, modify, and create derivative works of such User Content for the purpose of providing the Service and improving the Company’s Services, including commercial use. Without derogating from the foregoing, you acknowledge that any User Content that you choose to post on the Site will be visible to visitors to the Site and/or other users.
We respect the rights The property of others. If you believe that information or content, including User Content, on the Site infringes on your proprietary rights, please contact us using the contact information at the bottom of these Terms of Use , along with sufficient details to substantiate your claim. The Hotel will review the request at its discretion and act, as it deems appropriate, in accordance with the provisions of the law.
Site changes, malfunctions and service interruptions: The Hotel reserves the right to change or remove the Site Content (including User Content) and/or change or remove Services from time to time, in its sole discretion, for any reason at its sole discretion and without prior notice. The Hotel is not obligated to update any information or content on the Site.
The hotel will not be liable to you or any third party for any change, suspension or termination of the service and/or the website as aforesaid.
The hotel does not warrant that the site and/or services will not be interrupted, will be provided in an orderly manner or without interruptions, will be carried out securely and without errors, and will be immune from unauthorized access to the hotel's computers or from damage, malfunctions, malfunctions or failures - all in hardware, software, communication lines and systems at the hotel or at any of its suppliers.
Order and purchase on the website:
Bookings and purchases will be made through the booking system on the site. Accommodation units can be booked through the system, desired dates can be entered, and the required booking details can be entered, all subject to the hotel's approval and in accordance with the terms and conditions detailed in these regulations and the booking process.
Prices, availability of services and other purchase terms may change from time to time. The hotel reserves the right to change the range of services or discontinue them or change the price of services offered on and off the site, without prior notice.
Commercial bookings will not be allowed on the site. For commercial bookings, please contact the hotel using the contact details shown at the bottom of the regulations. This condition applies to bookings for more than 4 rooms and/or bookings for less than 4 rooms but a stay of more than 14 days, as well as to bookings by the same guest for more than 14 consecutive days, even if it is a continuation booking (i.e. an extension of a stay that ended before 14 days had passed since the last stay ended).
When ordering a service on the site, the purchaser is responsible for providing correct, accurate, up-to-date and complete information. Entering false purchase details is strictly prohibited. The hotel may verify the details entered after making a reservation, and may cancel or limit the reservation in the event that the details provided are found to be incorrect, incomplete or do not match the purchaser's details, all subject to the provisions of the law. To the extent that payment was made for a canceled reservation as stated, the payment amount will be refunded to the same means Payment, subject to the hotel's cancellation policy. The credit card check will be performed by pre-authorizing the credit card provided as security to ensure payment of the reservation amount, damages or fines during the reservation process or at the hotel's reception. The pre-authorization is a preliminary action that will be performed both at the time of booking (for a small amount up to NIS 300) and also near the date when the reservation according to the cancellation policy becomes a non-cancellable reservation (for a large amount that increases to the entire reservation).
If, for any reason, the credit card company refuses to transfer the payment amount for a reservation you have made, the hotel will be entitled to suspend or immediately terminate the provision of the service and may demand payment plus any costs incurred by the hotel due to the refusal (including third-party fines) by other means, at the hotel's discretion. If the hotel is forced to take legal action to collect payment balances, the purchaser undertakes to indemnify the hotel for all expenses incurred, including attorney's fees and other legal expenses.
Purchasing services on the site is subject to additional terms and conditions that will be detailed on the site.
It is clarified that as part of the purchase on the site, several messages will be sent to the customer, such as confirmation of the order, an invoice for the purchase (if made), information about the order, etc. The hotel reserves the right to transmit the messages by any means of communication, such as e-mail or text message to the phone.
A reservation will be considered confirmed only after receiving a reservation confirmation from the hotel, which includes the confirmation number and reservation details.
The hotel may not unilaterally confirm a reservation made and/or confirmed on the site, or cancel a reservation made on the site and automatically confirmed, in accordance with the hotel's decision and discretion, in cases where an error was made in the reservation, including an error in the transaction price, a technical error (e.g. overbooking ), an error in advertising the service, an error in the policy, and any other human error. The cancellation will be made no less than 7 days before the date of the vacation booked, unless the vacation was booked within an immediate period (less than 7 days between the date of booking and the date of arrival), in which case the cancellation will be made no later than 72 hours after the reservation is made .
If the hotel cancels a transaction as described in Section 9.9, the hotel will not charge the guest the cost of the transaction and will contact the guest to complete the transaction properly. The guest will not be entitled to or demand additional compensation or compensation due to the cancellation of the transaction.
Entering credit card details when making a reservation is done to provide the hotel with security for use in the event of no-show, or in the event of damage to the hotel (such as loss of equipment provided in the room, or breakage or causing a fire, etc.), or violation of the hotel's terms of accommodation (such as fines for late check-out, causing noise nuisance, or smoking in the room, etc.), And also for depositing a deposit or collecting an advance payment in the event that this is required according to the terms of the order, as well as in the case of orders without the possibility of a refund of the cost of the order at the time of placing the order .
Unless otherwise presented or required as stated, payment for the reservation will be made at the hotel upon arrival, or in accordance with the cancellation policy of the reservation.
Check-in and check-out hours
Check-in time (entrance to the accommodation unit) is from 3:00 PM on the date of commencement of the stay. Check-out time (exit from the accommodation unit) is until 11:00 AM on the date of termination of the stay.
Requests for early check-in or late check-out are subject to availability and confirmation by the hotel, and may incur additional charges. The unit cannot be assumed to be available outside of these hours without prior arrangement.
Late check-out beyond the scheduled time may result in an additional charge of one additional day and night, according to the hotel's price list. The hotel reserves the right to charge an additional fee or charge the credit card without prior notice in the event of late check-out.
The hotel may cancel a reservation without refund in the event of a no-show until 11:59 p.m. on the day of the start of the stay, unless the hotel is notified otherwise in advance.
Payment in cash, subject to the hotel's approval, will be made in accordance with the law, including in accordance with the provisions of the Law for Reducing the Use of Cash, 2018.
Order change and cancellation policy:
A request to change or cancel a transaction will be forwarded to the hotel via one of the means of contact that appear at the bottom of the regulations or via the personal area.
Cancellation of an accommodation service order and receipt of a refund will be possible within 14 days of making the transaction or from the date of receipt of the transaction details (whichever is later), provided that there are more than 14 non-holiday days remaining until the accommodation date.
In a distance selling transaction carried out by a person with a disability, a senior citizen or a new immigrant, as defined in the Consumer Protection Law, when the engagement in the transaction also included a conversation between you and the hotel (including a conversation via electronic communication), you are entitled to cancel the transaction within four (4) months from the date of making the transaction or from the date of receiving the The document containing the main points of the transaction, whichever is later , provided that the cancellation is made before the actual provision of the service.
In the event of cancellation as stated in Section 10.2 above, the customer will be charged a cancellation fee of 100 NIS or 5% of the order value, whichever is lower.
This policy is the basic policy of the hotel. Specific and/or additional terms may apply in connection with various promotions offered by the hotel. These specific terms will appear in the booking process during the purchase and in the booking confirmation and will apply in connection with the said booking.
No refund will be possible in the case of a reservation from a price list that includes immediate payment, full or partial, in a cancellation made after 14 days from the date of placing the reservation or from the date of receipt of the transaction details document (whichever is later) and the cancellation date does not fall within 7 days that are not rest days prior to the accommodation date, or in the case of failure to arrive at the accommodation complex without prior notice.
Cancellation and refund will be confirmed after the customer receives a message from the hotel confirming this.
Any refund will be made using the payment method used by the customer to make the purchase.
The above is subject to the provisions for canceling a transaction in accordance with the Consumer Protection Law, 5741-1981.
How to make refunds
Any refund approved by the hotel will be made to the same payment method used for the original purchase, unless otherwise agreed.
The refund process will take up to 14 business days from the date the hotel confirms the cancellation in writing, but additional time may pass before the funds are actually credited to your account, depending on the credit card company or bank policy.
In the event of a partial refund (such as a cancellation with a cancellation fee), the refund will be less the cancellation fee and/or non-refundable payments in accordance with the cancellation policy.
In the event that the reservation included additional services provided by third parties (such as tours, transportation services), the refund for these services will be subject to the cancellation policy of those third parties.
It is the customer's responsibility to ensure that written confirmation of the cancellation and refund is received. The hotel will send confirmation to the email address provided at the time of booking.
Hotel Responsibilities:
The contents on the site are available for use as is ( AS IS ), and cannot be adapted to the needs of each and every person. The user of the site agrees that he will not have any claim, claim or demand against the hotel for the properties of the contents, their capabilities, limitations and/or their suitability for his needs, and the use of the site will be the sole responsibility of the user of the site.

The information appearing on the site should not be considered a guarantee of any result and/or a liability for the manner of activities of the services sold on it. The hotel will not be liable for any damage, direct or indirect, that may be caused to the surfer as a result of reliance on information appearing on the site (including any content and/or user content) and/or links to other sites and/or any other internal and/or external information source and/or use of the services presented by it.
The images on the site are displayed for illustrative purposes only. A clerical error in the description of a service and/or its price will not bind the hotel.
Information and presentations regarding products and/or services displayed on the site, which originate from the hotel's business partners and/or third parties whose products and/or services appear on the site, and any content regarding the products and/or services, are the sole responsibility of the said business partners and/or third parties, and therefore it is understood that the hotel has no liability for such information, and the hotel does not guarantee the accuracy of this information.
The responsibility for entering the correct purchase details and ordering the requested service, dates, accommodation units, meals, and any other service applies solely to the customer. The hotel will not be responsible for errors made by the customer.
The hotel recommends that users of the site act as prudent and cautious consumers, and carefully read the information presented on the site, including the information regarding the service itself, its description and suitability, as described on the site.
The provision of the service will be possible subject to the sole discretion of the hotel and the hotel will not be responsible for any delay and/or delay in providing the service and/or failure to provide the service, as a result of force majeure and/or events beyond its control, including a state of combat, war, general mobilization, epidemics, fire, floods and other natural disasters, strike or shutdown, acts of sabotage, disturbances to public order, an act or omission of a third party or restrictions imposed by it, laws, regulations, orders or other government directives, security restrictions or any other event beyond its control.
Emergencies, pandemics, and government restrictions
In the event of a state of emergency, war, pandemic, lockdown order, Ministry of Health guidelines or instructions from another authorized authority prohibiting the hotel's activities or travel to the area, the hotel may cancel reservations without a cancellation penalty, and without being liable for compensation beyond the refund of payments actually made (to the extent paid).
In these cases, the hotel will notify the customer of the cancellation as soon as possible and will refund all payments made within 14 days of the cancellation date, unless the parties have agreed otherwise.
In the event that the guest chooses not to arrive at the hotel due to concerns about a security situation, pandemic or emergency, but the hotel is open and operating as usual, the hotel's normal cancellation terms will apply.
The hotel may change the manner in which services are provided, close certain services (such as a pool, dining room, spa) or impose restrictions on guests in accordance with the guidelines of competent authorities, without changing the reservation price, unless the change is substantial in a way that justifies a proportional refund.
The hotel may require guests to comply with health guidelines, such as completing health declarations, taking temperatures, wearing masks, or presenting vaccination certificates, in accordance with government guidelines. Failure to comply with these requirements may result in denial of entry without a refund.
The hotel will not be responsible in the event that a reservation and purchase are not received in the system and/or in the event of technical malfunctions on the site and/or any other problem that prevents the user from making a reservation and purchase on the site.
Rules of conduct in the hotel complex and physical services
Guests undertake to act with respect and courtesy towards hotel employees, other guests and third parties during their stay in the complex.
Guests are required to maintain quiet and not disturb the comfort of other guests, especially late at night and early in the morning. The hotel may set and enforce quiet hours.
Any violent, threatening, insulting, racist or discriminatory behavior towards any person on the premises is prohibited. The hotel reserves the right to terminate the stay immediately and without refund in the event of such behavior.
Smoking is prohibited in the guest rooms and enclosed areas of the hotel, except in designated areas marked for this purpose (if any). Violation of this prohibition will result in a fine of [fill in amount - e.g.: 1,000 NIS] for special cleaning and odor removal, which will be charged to the credit card.
Pets are not allowed on the hotel premises without prior arrangement and written approval from the hotel. In the event of a pet being brought in without approval, the hotel may require the animal to be removed or terminate the stay without a refund.
Food and alcoholic beverages from outside the hotel are not allowed into the premises without prior approval, especially for events and group entertainment.
The hotel may refuse to provide services or terminate the stay of a guest (including the evacuation of the guest from the hotel and his belongings) who violates these rules or behaves in a manner that harms the security, public peace or comfort of other guests, refuses to obey the instructions of the hotel staff or endangers the equipment - without being obligated to refund money.
In the event of termination of stay due to violation of rules of conduct, the hotel may charge the full cost of the reservation, including for unused nights.
Jurisdiction:
These regulations and the use of the site and/or services will be governed solely by the laws of the State of Israel, but the rules of choice of international law set forth therein will not apply.
To the courts in the Tel Aviv district There will be exclusive jurisdiction in any matter arising from and/or related to the regulations and/or legal disputes that may arise between you and the hotel.
Accuracy/technical and other corrections:
The website as a whole, including all information appearing therein, is offered to the public as is, and will be as accurate and correct as possible, however, the information may be incomplete or alternatively, technical or other errors may have occurred in the information. The hotel reserves the right to correct such errors and/or inaccuracies and/or update the information on the website at any time and without prior notice.
Warranty and Limitation of Liability
Subject to any law, the Hotel shall not be liable for any inconsistency, lack, deception or error in connection with the content of the Services and/or the Site, including in connection with the quality or suitability or description of the services offered on the Site. Subject to any law, the Hotel shall not be liable for any damage caused directly or indirectly due to the use of the Site and/or the Services. You undertake and declare that you are aware of and agree that the use of the Services and the Site is at your sole risk. The use of the Site, the Services and/or the content presented therein is provided to you AS IS and subject to its availability ( AS AVAILABLE ), in accordance with the Hotel's decision and without warranty of any kind, including being personalized to your needs.
You will have no claim, claim or demand against the Hotel in relation to the terms of the Regulations and/or in respect of the Site, the Services, their capabilities, limitations, or their suitability for your needs. Subject to any law, any reliance on the Content (including User Content) is at your sole risk and the Hotel disclaims all warranties, express or implied, with respect to the accuracy, reliability, timeliness, currency, quality, completeness, usefulness, security or performance of the Site and/or the Services and/or the Content and/or the User Content and/or any information available through the Site and/or the Services and/or that the Content (including User Content) will be error-free or that errors, if any, will be corrected.
Subject to all law, the Hotel disclaims any and all warranties of any kind, express, implied or statutory, and does not warrant that the Site and/or Services will be provided in a timely manner or without interruption, will be of high quality, will be carried out securely or without errors and/or interruptions, or will be immune from unauthorized access to the Hotel's computers and/or software, or from damage, malfunctions, faults or failures, among other things, in hardware, software, communication lines and systems at the Hotel or at any of its suppliers or at yours, and you will have no claim against the Hotel in this regard. You are aware that the Site and/or Services may not be available in the future due to maintenance, upgrade needs or for any other reason.
Third Parties. We cannot control the services provided by third parties and are not responsible for any failure or interruption in a telephone line or network, or traffic congestion on the Internet or on the Site itself. We cannot control the actions of malicious parties and do not guarantee that we will be able to prevent unauthorized access to or modification of the Site and/or Services.
Users. We cannot predict or control the actions or omissions of others, including our users. We are not responsible, regardless of the form of action, for the actions or omissions of any users that do not result from gross negligence or willful conduct on our part.
Data Storage. We are not a data storage service. It is your sole responsibility to back up any data you provide to us. If the data you provide to us is lost or corrupted for any reason, we will not be liable for any damage or loss you incur if you are unable to recover the data.
Subject to any law, the hotel, its directors, officers, employees, agents or shareholders shall in no way be liable to you or to any third party for any loss, damage or compensation whatsoever, including, without limitation, indirect, incidental, consequential, incidental, secondary, punitive or special damage or compensation (including but not limited to damage for loss of database, loss of software, costs of providing an alternative service, violation of privacy or interruptions in service) arising from anything relating to the terms of these regulations, from the use or inability to use the site, services, content (including user content) and/or anything related to them, from the performance of a transaction, or as a result of unauthorized use of the site or services, as a result of changing the information provided by you, including damage caused by loss of profits, use and loss of information and other intangible assets, even if the hotel has been notified of the possibility of such losses. To the maximum extent permitted by law, the total and aggregate liability of the Hotel under any of the terms of these Terms and Conditions shall not exceed the amount you paid to the Hotel in connection with the Services during the three (3) month period prior to the relevant claim.
Personal information may be obtained from you during your use of the Site and/or Services. Any use made by the Hotel of the personal information obtained during your use of the Site and/or Services will be subject to the provisions detailed in the Privacy Policy. You acknowledge that by providing the personal information as aforesaid, including without limitation, contact information, you declare that you are aware of the risks involved and you release the Hotel from any liability therefor.
In light of the foregoing, you understand that use of the Site and Services involves a certain degree of risk. When you choose to use the Site and Services, you do so at your own discretion and assume the risks involved. Under applicable law, limitations of liability may not be possible in certain areas and some of the above limitations of liability may not apply to you. Accordingly, you agree to indemnify and defend the Hotel, its affiliated companies, its employees, directors, officers, business partners and suppliers and to bear all their expenses for any claim, allegation, demand, loss, loss of profit, payment, expense or damage, including attorney's fees and legal expenses (including those of a third party), arising, directly or indirectly, from one or more of the following cases: (a) violation of one or more of the terms of the Regulations by you or by a user of your device or personal account; (b) as a result of the manner in which you use or attempt to use the Site or the Services; (c) violation of the provisions of any law to which you are subject; (d) violation of any right (including intellectual property) of the Hotel and/or any third party; (e) Breach of any of your representations and obligations under the Terms and Conditions; (f) Damage caused to the Hotel's property by you or by anyone on your behalf; (g) Offensive, insulting or threatening behavior towards Hotel employees, other guests or third parties; (h) Disturbance of order, causing excessive noise or conduct that harms the comfort of other guests; (i) Failure to comply with the Hotel's house rules and procedures; and (j) Any other matter for which you are responsible under any law.

Without derogating from any other provision in these Terms and Conditions, the Hotel reserves the right to prevent any surfer from using the Site (including blocking certain IP addresses ), for any reason or justification whatsoever (without having to provide a reason or justification), at its sole discretion, without the need for prior notice or warning and without being liable for any damage resulting from its decision. Nothing in these Terms and Conditions creates any joint venture, agency, partnership, or other arrangement between you and the Hotel or authorizes you to act on behalf of the Hotel. The Terms and Conditions reflect the entire agreement between the parties regarding the Terms and Conditions of the Site and the Services and the relationship between the parties and will supersede any prior agreement or undertaking, oral or written. The Hotel may assign, transfer or transfer its rights and obligations under the Terms and Conditions, or any part thereof, to any third party in its sole discretion. You may not assign, transfer or transfer your rights and obligations under the Terms and Conditions, or any part thereof, and any such attempt to assign shall be null and void.
